Fair dismissal code now available

The Small Business Fair Dismissal Code has been published today.

Employers qualify as small businesses if they have fewer than 15 full-time equivalent employees until January 1, 2011. After that, the threshold will continue to be 15 employees, but by headcount.

Acting Workplace Relations Minister Senator Mark Arbib made the declaration containing the code last Wednesday under the Fair Work Act's
s388 small business fair dismissal code provision, but it has only become publicly available today.

The code is the same as that
published in September last year except that a comma has been deleted in the "other dismissal" section (see Related Article).

Explanatory statement

Meanwhile, the Federal Court has
amended its rules to prepare for the new Fair Work jurisdiction that starts on July 1.

The Federal Magistrates Court has made
similar amendments to its rules.
